Payment
Payment for the agreed work shall be made in full on or before the due date of the invoice; or as agreed.
Late Payment Fees
A late payment fee may be charged on any amount owing after the due date at the rate of 15% per month. Any expenses, disbursements and legal costs incurred by Leithel Images in the enforcement of any rights contained in this Agreement shall be paid by the Client, including any reasonable solicitor’s fees or debt collection agency fees.
Copyright
Leithel Images retains copyright on all images supplied to clients until payment has been made in full, including applicable late payment fees, after which limited rights are transferred to the client. Photography is supplied with an ‘All Uses’ license, covering worldwide advertising, POS, catalogue, magazine, brochure and web use. In the event of non payment of an invoice Leithel Images reserves the right to revoke the ‘All Uses’ license and to pull copyright without notice. If, for any reason, payment is not received, either due to delay in paying, dispute over images supplied, or any other reason, the client may not use any images supplied what so ever in any circumstances, in any form of media, print, web, social, presentations or marketing collateral.

Images owned by Leithel Images being used without rights will be invoiced to the organisation using at no less than $700 AUD + GST per image, per instance. This will be enforced by Australian copyright laws. Damages and compensation may be applicable in excess of this. 
Portfolio Use
Our default licensing agreement with all clients, unless specifically negotiated otherwise permits Leithel Images full use of all photos taken to be used on our own website, online or print advertisements or as part of our client portfolio and advertising strategy. 
Product Photography
Product Quality and Resulting Image
A) Leithel Images will photograph the item as it arrives at the studio. If the item has flaws, mis-labeled, “waves” in the labels, nicks in the package or products, scuffs, scratches, manufacturing defects, inherent damage, it will be photographed as such.
B) If the item arrives unacceptably damaged as determined by our receivables department, you will be contacted and given a chance to send a new item to be photographed.
C) Leithel Images may retouch certain minor flaws inherent in the product but it is not required to.
D) Leithel Images can provide propping for a photo but the client must provide all props for the photograph. Clear direction is required. Additional charges may apply.
Image Sizing & Resolution
A) Image delivery types are picked by the customer and are defined in prior to delivery.
B) Leithel Images will not be held responsible for resizing or reformatting images to fit the clients wide range of possible uses.  The image sizes are delivered in large format to enable the majority of standard uses, for example on a website, in a standard sized catalog or printed in a magazine.
C) Leithel Images will not deliver layered PSD files. The .tif format (also known as .TIFF) carries all the same properties of a PSD file but at a smaller file size.  
D)  Leithel Images will not deliver raw file. Use of advanced retouching methods, utilising multiple layers and image components, make up the final delivered image. 
Product Delivery & Return
All products to be photographed, to be delivered to the Leithel Images studio location by the client or at the clients expense. Product returns to be arranged by the client at the Clients expense. 
Any products not collected or arranged for return within 30days, are deemed property of the photographer and any subsequent disposal costs, will be at the Clients expense.

We reserve the right to update or change our Privacy Policy at any time and you should check this Privacy Policy periodically. Your continued use of the Service after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.
